Terms of Service

Effective: 21 September 2026  ·  Last updated: 21 September 2026  ·  Version: 1.2

What changed in 1.2: two things we were already doing are now written down. Every message is deleted 30 days after it is sent, in every kind of conversation and including photos (new section 4.4; Feedback moves to 4.5). And reports go to us, not to community moderators — section 5 previously asked moderators to “deal with reports”, which they have never been able to see. No other right or obligation has changed.

What changed in 1.1: wording only. What these Terms called an “outing” is now called an activity, which is what the app calls it. No right, obligation or practice has changed.

These Terms are the agreement between you and Jadoon Tech for the use of Qafila — the mobile app and the website at qafilaapp.com. By creating an account or using Qafila, you accept them. If you do not accept them, do not use Qafila.

Please read section 8 carefully. Qafila helps you find places to do adventure and outdoor sports. Those activities carry real risk of serious injury or death. We do not inspect, supervise or certify any spot, venue, activity, organiser or participant. You take part at your own risk.

1. Who may use Qafila

You must be at least 13 years old to use Qafila, and at least 16 where your country sets a higher age for consenting to online services. If you are under 18, you may use Qafila only with the involvement of a parent or guardian who agrees to these Terms.

You must not use Qafila if you are barred from doing so under the laws of your country, or if we have previously terminated your account.

2. Your account

3. Using Qafila

You agree not to:

Land access is your responsibility. A spot appearing in Qafila is not permission to be there. Obtain the landowner's consent and any permit, licence or qualification your activity or location requires.

3.1 No scraping or data extraction

You have no permission to extract Qafila's data. Your licence is to use the app to find places and people for your own sporting activity. It is not a licence to copy the underlying database, in whole or in part, by any means.

The spot and venue directory, the trail and route data, the marketplace listings and shop catalogue, community and member directories, activity and tournament records, reviews, ratings, verification status, photographs, and the coordinates, altitudes, access notes and conditions attached to any of them are a compiled database built at our expense and by our users. It is protected as a compilation and, where applicable, by database rights, independently of who owns any single entry within it.

Without our prior written permission, you must not:

These restrictions apply however the data is reached, including through a public link, a shared community handle, a QR code, a cached copy or a search engine result, and they survive the closure of your account.

Search engines may crawl the pages we expose for that purpose, in accordance with our robots directives. Nothing here stops you using your own content, or taking a reasonable personal copy of a handful of spots for your own trip.

If you want bulk or programmatic access — for research, for a club, or for a product — ask. Email jadoontech@outlook.com. We would rather say yes on terms than find out later.

Automated access is a breach we take seriously: we may block addresses, terminate accounts, and pursue any remedy available to us, including injunctive relief and the recovery of costs. Because unauthorised extraction causes damage that is difficult to quantify, you agree that an injunction is an appropriate remedy.

4. Your content

4.1 You keep ownership

You own the content you create. These Terms do not transfer ownership of it to us.

4.2 The licence you give us

To operate Qafila we need permission to handle your content. You grant Jadoon Tech a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, reproduce, adapt (for example to resize an image), publish, distribute and display the content you post, for the purpose of operating, improving and promoting Qafila.

This licence ends when you delete the content or your account, except that: (a) copies may persist in backups until they are overwritten on their normal cycle; (b) content you shared into a conversation or community may remain with the people you shared it with; and (c) content that has become part of a shared record — a tournament result, for example — may remain.

4.3 You are responsible for it

You confirm that you have the rights to everything you post, and that posting it does not break the law or infringe anyone's rights.

4.4 Messages are not storage

Every message you send is deleted 30 days after it is sent, along with any photo attached to it. This applies to direct messages, private group chats and community chat alike; it is automatic, it applies to every copy, and it cannot be switched off. Chat in Qafila is for arranging the outing, not for keeping it. Do not rely on a conversation to hold anything you need to keep — save it somewhere that is meant to hold it.

4.5 Feedback

If you send us suggestions about Qafila, we may use them without obligation or payment to you.

5. Communities and moderation

Anyone can create a community. If you create or moderate one, you are responsible for what happens in it: apply these Terms, keep the place in order, and do not use moderator powers to harass members.

Reports are not part of that job. A report made in the app comes to us and to nobody else — moderators do not see reports about their own community, and are not told who made one. A moderator may still remove content or a member from their own community on their own judgement; acting on a report is ours to do.

Spots are community-verified. Confirmations, corrections and reviews are the opinions of the people who wrote them. We do not verify them and do not guarantee that any spot information is accurate, current, safe or legal to access.

Some content is scanned automatically to help us find material that breaches these Terms. Automated scanning flags content for a human to review; it does not by itself remove content or restrict accounts. See the Privacy Policy.

6. The marketplace

Qafila is not a party to your transaction. The marketplace is a place for buyers and sellers to find each other. We are not the seller, the buyer, an agent, an escrow service or a payment processor. Any sale is a contract between you and the other person.

If you list something:

If you buy something, inspect it before you pay where you can. We do not screen listings, sellers or buyers, do not hold funds, and offer no refund, guarantee or buyer protection. Safety-critical equipment — a paraglider wing, a harness, a reserve, a rope, a helmet — can be unsafe in ways that are not visible. Have it inspected by a qualified person before you use it.

7. Activities and tournaments

Activities and tournaments are organised by users, not by Qafila. The organiser is responsible for the event, including any permit, insurance, supervision, safety cover and qualification required. We do not vet organisers or participants, and we are not responsible for what happens at an event.

8. Assumption of risk

Qafila covers activities — including paragliding, climbing, trekking, cycling and other outdoor and adventure sports — that are inherently dangerous and can result in serious injury, permanent disability or death. Conditions such as weather, terrain, water and snow change without warning.

You acknowledge and agree that:

To the fullest extent permitted by law, you assume all risk arising from your use of information found in Qafila and from any activity you undertake as a result.

Qafila is free to browse. We may offer paid plans or features. If and when we do, the price, billing period and what is included will be shown before you buy, and purchases made through an app store are processed by that store under its own terms — including its refund policy. Subscriptions renew until cancelled, and you cancel through the store account you bought them with.

Where paid features are not yet available, nothing in Qafila is an offer to sell them.

10. Our intellectual property

Qafila, the Qafila name and logo, the app, the website and everything in them other than user content are owned by Jadoon Tech and protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. All rights not expressly granted are reserved.

Our rights include the selection, arrangement and compilation of the content in Qafila — the directory itself — separately from the individual entries within it. Section 3.1 sets out what that means in practice.

11. Reporting and enforcement

Report anything that breaches these Terms using the in-app report action, or by emailing jadoontech@outlook.com. Either way it reaches us directly and not the community the content sits in. If you believe content infringes your copyright, email us with enough detail to identify the work and the content, and a statement that you are the rights holder or authorised to act for them.

We may remove content, limit features, or suspend or terminate an account that breaches these Terms. Where it is reasonable and lawful to do so we will tell you why, and you may reply to us at the address above.

12. Suspension and termination

You can stop using Qafila at any time, and you can ask us to delete your account as described on the delete your account page.

We may suspend or terminate your access if you breach these Terms, if it is necessary to protect other users or us, or if we are required to by law. We may also discontinue Qafila, or any part of it; where we do so other than for an urgent reason, we will give reasonable notice.

Sections 4.2, 8, 10 and 13 to 16 survive termination.

13. Disclaimers

To the fullest extent permitted by law, Qafila is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that Qafila will be uninterrupted, secure or error-free, that defects will be corrected, or that any content or information in it is accurate, complete, current or reliable.

Nothing in these Terms excludes or limits any right you have that cannot lawfully be excluded or limited, including consumer rights in your country.

14. Limitation of liability

To the fullest extent permitted by law, Jadoon Tech and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or relating to your use of Qafila, however caused and on any theory of liability.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or Qafila is limited to the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 50.

We are not liable for the conduct of other users, for any transaction between users, for any event organised by a user, or for any injury or loss arising from an activity you chose to undertake.

Nothing in this section limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.

15. Indemnity

You agree to indemnify and hold harmless Jadoon Tech against any claim, damage, loss, liability and reasonable legal cost arising from your content, your use of Qafila, your breach of these Terms, or your violation of any law or of the rights of a third party.

16. Governing law and disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws rules. The courts of Pakistan have exclusive jurisdiction over any dispute, except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory protections and the right to bring proceedings in the courts of your country of residence where the law gives you that right.

Before starting formal proceedings, please contact us — most problems are quicker to solve by email.

17. App store terms

If you download Qafila from the Apple App Store, you acknowledge that these Terms are between you and Jadoon Tech, not Apple; that Apple has no obligation to provide maintenance or support for the app; that Apple is not responsible for any claim relating to the app, including product liability, a failure to conform to a legal requirement, or a claim under consumer protection or privacy law; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties. Your use must comply with the applicable third-party terms of service.

If you download Qafila from Google Play, your use is also subject to the Google Play Terms of Service.

18. Changes to these Terms

We may update these Terms as Qafila changes. The effective date at the top tells you which version is current. For material changes we will give notice in the app or by email before they take effect. Continuing to use Qafila after that means you accept the updated Terms; if you do not accept them, stop using Qafila and ask us to delete your account.

If any provision of these Terms is held unenforceable, the rest remains in force. Our not enforcing a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us about Qafila.
